Terms of service for using PHILFACO Logistics

1. Acceptance of Terms

By accessing or using PHILFACO Logistics' website and services, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.

2. Services Description

PHILFACO Logistics provides freight forwarding, customs clearance, warehousing, and supply chain management services. We reserve the right to modify or discontinue any service at any time.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized use

4. Shipping and Delivery

We strive to provide accurate delivery estimates, but actual delivery times may vary due to factors beyond our control, including:

  • Customs clearance delays
  • Weather conditions
  • Political unrest or strikes
  • Mechanical issues

5. Pricing and Payments

All prices are subject to change without notice. Quotes provided are estimates and final charges may vary based on actual weight, dimensions, and services required.

  • Payment is due upon receipt of invoice
  • Late payments may incur interest charges
  • All fees are in KES unless otherwise stated

6. Prohibited Items

The following items are prohibited from shipment through our services:

  • Illegal drugs and narcotics
  • Hazardous materials without proper documentation
  • Firearms and explosives
  • Perishable goods without proper packaging
  • Counterfeit goods

7. Limitation of Liability

PHILFACO Logistics' liability for lost or damaged shipments is limited to the declared value of the shipment, up to a maximum of $100 USD per shipment unless additional insurance is purchased.

8. Indemnification

You agree to indemnify and hold harmless PHILFACO Logistics from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.
